£58,000 of debt - but can't do an IVA.

Debt: £58,000 Was paying: £1267/month
Now paying: £300/month
Client has £200,000 equity in his home & unsecured debts of £58,000. His assets are more than his debts, but he can't pay 11 creditors from a monthly income of £1,060.
An IVA is not possible as his creditors would never agreed to forgive any debt when he could repay them in full by selling his property. The client does not want to remortage as he has recently become self employed and does not want to risk his home if that does not go to plan. Debt management will never pay off this debt, but it gives our client some respite from his creditors while he focuses on building his business without the fear or court action or losing his home.

3 Random Q&A's from the database:-

1. How much will my debt management payments be ?

It depends on your ability to pay based on your income and essential outgoings, not the total debt or current repayment levels. We agree with your creditors a reasonable amount you can afford allowing for some left over for emergencies. Minimum payments are £100 per month or £25 per week.

2. Will I receive a Default Notice ?

By coming on plan with us, you will be in default on your original credit agreement and your creditor is therefore entitled to send you a Default Notice. Creditors send out Default Notices to protect their own legal position.

3. Can i exclude a particular debt or credit card from my programme ?

No, the principal reason debt management allows reduced payments is that all creditors are treated equally. By excluding one debt, then you are showing favoritism and your other creditors will not agree to this and my resort to court action
